Family Research Council: 'Matthew Shepard Story a work of fiction; Calls Federal Judge a 'Clown'

Washington Update, a publication of the right wing organization, The Family Research Council, has likened a story about the murder of Matthew Shepard in Laramie, Wyoming in 1998 to Brokeback Mountain, a fictional short story written published by The New Yorker, PageOneQ has found.

Under a headline, "From the 9th Circus," an apparent reference to the United States Court of Appeals for the Ninth Circuit, FRC president Tony Perkins condemned the Court for ruling that a shirt with the phrase "Homosexuality is Shameful Romans 1:27," printed on it was inflammatory speech.

Tyler Harper, the student who word the shirt, did so in response to the school's "Day of Silence," a program in which participating students remain silent for a day in solidarity with their fellow students who face LGBT oppression.



In the ruling (available here), Judge Stephen Reinhardt refers to Judge Alex Kozinski's dissenting opinion (available here), recommending that the dissenting Judge turn to the film Brokeback Mountain and the television production The Matthew Shepard Story, "as evidence of the harmful effects of anti-gay harassment..."

Mr. Perkins, of the Family Research Council, took quotes from the story above and wrote that the Court took pointed to, "Hollywood's Brokeback Mountain and The Matthew Shepard Story - two works of fiction."

In the entry, posted yesterday, Mr. Perkins calls the opinion's author, Judge Reinhardt, a "clown." " Most circus clowns make you laugh, but not this clown. Remember Judge Stephen Reinhardt?" wrote Perkins.

Most circus clowns make you laugh, but not this clown. Remember Judge Stephen Reinhardt? Married to the former director of the Los Angeles ACLU, he sits on the 9th Circuit Court of Appeals where he has declared the pledge of allegiance unconstitutional because of the phrase "one nation under God." Last November he ruled that parents do not have a right to object to elementary schools teaching their children about sex. Now he has issued a ruling that compares the wearing of a T-shirt with Romans 1:27 to the displaying of the Confederate flag. Reinhardt declared that the T-shirt which read "Homosexuality is Shameful Romans 1:27," was "inflammatory," plainly offensive speech that creates a "hostile" environment and is "detrimental to the "psychological health" of homosexual students. The case involves a California high school student, Tyler Harper, who responded to his school's endorsement of last year's "Day of Silence" by wearing the T-shirt the following day. Reinhardt substantiates his claim that homosexuals are a persecuted minority, in part, by pointing to Hollywood's Brokeback Mountain and The Matthew Shepard Story - two works of fiction. Reinhardt and others like him will do whatever it takes to silence the truth. That is why beginning this year the Alliance Defense Fund, which represented Tyler in this case, is promoting "The Day of Truth," which will be held this Friday, the day after the "Day of Silence."
