VIDEO: CNN incorrectly reports on California gay marriage ruling

by PageOneQ

The Cable News Network (CNN), a few moments after 1pm ET today, reported that the Supreme Court of California ruled against marriage rights for gay and lesbian couples.

Just one small problem: They didn't bother to read the whole ruling before reporting the story.

While the Court determined by a 4-3 vote that the City and County of San Francisco acted unlawfully by issuing 4,037 marriage licenses to gay and lesbian couples, it ultimately issued a win for such couples in California, ruling that the existing domestic partnership law was insufficient, and that barring gay couples from civil marriage was unconstitutional.

CNN legal analyst Sunny Hostin said that "...there's going to be a contingency of people and a contingent that are very unhappy with the decision. I can't think it was unexpected; we knew that the top court of California was going to decide today whether to legalize same-sex marriage, and it appears that they have determined that they would not legalize same-sex marriage."

The Closed Caption transcript of the broadcast follows.

::Just a few minutes ago we told you about that same-sex marriage legislation in front of the California supreme court. a decision has been made and it's just coming down. pardon me for reading it off the wire here. in the decision of Locher versus the city and county of San Francisco, the court concluded that public officials of the city and county of San Francisco acted unlawfully by issuing marriage licensees to same-sex couples in the absence of a judicial determination that California statutes limiting marriage to a union between a man and a woman are unconstitutional. Our decision emphasized, however, that the substantive question of the constitutional -- that's the end of the copy i have here. there is a much longer version i would have to click on. to understand this, we have to get our legal analyst to join us by telephone. did you hear what i said about this ruling?

::I could not. i heard some of it, but i did not hear all of it. my understanding is the court now rules that the city and county of San Francisco acted unlawfully.

::unlawfully by issuing marriage licensees.

::I think people are going to -- there's going to be a contingency of people and contingent unhappy with decision. I can't think it was unexpected but we knew top court of California was going to decide today whether to realize same-sex marriage. It appears that they have determined they would not legalize same-sex marriage.
